- (b) The Website is operated by BFD Education Pty Ltd (ABN 97 631 693 788). Access to and use of the Website, or any of its associated Products or Services, is provided by BFD Education Pty Ltd. By using, browsing or reading the Website you agree to be bound by these Terms.
- (c) BFD Education Pty Ltd reserves the right to review and change any of the Terms by updating this page at its sole discretion. Any changes take immediate effect from the date of publication.
2. Acceptance of the Terms
You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by BFD Education Pty Ltd.
3. Subscription to use the Services
- (a) In order to access the Services you must purchase a subscription through the Website and pay the applicable subscription fee.
- (b) It is your responsibility to ensure that the subscription you purchase is suitable for your needs.
- (c) Once purchased, you must register an account before accessing the Services.
- (d) During registration you may be required to provide personal information including:
- (i) Email address
- (ii) Password
- (e) You warrant that the information you provide during registration is accurate and up to date.
- (f) Once registered you become a Member and gain access to the Services for the duration of the Subscription Period.
- (g) You may not use the Services if:

4. Your obligations as a Member

BFD Education Pty Ltd will only provide refunds if Services cannot be provided or if management determines a refund is reasonable. Any refund will be proportional to the unused subscription period.
7. Copyright and Intellectual Property
- (a) All content on the Website including text, graphics, logos, videos and code is protected by copyright.
- (b) BFD Education Pty Ltd grants Members a limited licence to:
- (i) use the Website according to the Terms
- (ii) store pages in cache memory
- (iii) print pages for personal non-commercial use
- (c) BFD Education Pty Ltd retains all rights to the Website and Services.
- (d) You may not reproduce, distribute or modify Website content without written permission.
8. Privacy
Your use of the Website and Services is subject to the BFD Education Pty Ltd Privacy Policy available on the Website.
9. General Disclaimer
- (a) Nothing in these Terms excludes guarantees provided under Australian Consumer Law.
- (b) To the extent permitted by law BFD Education Pty Ltd excludes liability for indirect or consequential loss.
- (c) Use of the Website and Services is at your own risk.
- (i) failure of performance or interruption

- (iii) costs incurred from use of the Services
- (iv) issues arising from third party links
10. Education Services
- (a) BFD Education Pty Ltd is not liable for decisions made based on information or guidance provided.
- (b) Information provided is not intended to replace professional financial or legal advice.
11. Limitation of Liability
- (a) Total liability of BFD Education Pty Ltd will not exceed the resupply of the Services.
- (b) BFD Education Pty Ltd is not liable for indirect or consequential damages including loss of profit or reputation.
12. Termination of Contract
- (a) The Terms apply until terminated by either party.
- (b) You may terminate by:
- (i) not renewing your subscription
- (ii) giving 5 business days notice
- (iii) closing your account
- (c) BFD Education Pty Ltd may terminate the Terms if you breach them or if Services become commercially unviable.
- (d) Access to the Website may be suspended without notice if you breach these Terms.
13. Indemnity
- (a) You indemnify BFD Education Pty Ltd against claims arising from your content.
- (b) Any consequences of accessing or using the Website.
- (c) Any breach of the Terms.
14. Dispute Resolution
If a dispute arises the parties must attempt to resolve it through negotiation before commencing legal proceedings.
- (a) Parties must attempt resolution within 14 days.
- (b) If unresolved a mediator may be appointed.
- (c) Mediation costs are shared.
- (d) Mediation will occur in Perth, Australia.
15. Venue and Jurisdiction
Disputes will be resolved in the courts of Western Australia.
16. Governing Law
The Terms are governed by the laws of Western Australia.
17. Independent Legal Advice
Both parties confirm they have had the opportunity to obtain independent legal advice.
18. Severance
If any part of these Terms is found unenforceable the remainder will remain in effect.
